The Charlotte County Sheriff’s Office arrested the mother and father of a 17-month old baby boy and charged them with Homicide/Aggravated Manslaughter of a Child. A warrant was issued for the Port Charlotte couple, Amber Rose Landry, 29, 4485 Church Street and Scott Paul Landry,31, 20289 Kindermac Avenue. Both were located and arrested Friday then taken to the Charlotte County Jail where they remain without bond.
On Nov. 17, 2011 deputies responded at 12:30 p.m. to 27068 Chile Drive, Deep Creek, on a call about a non-responsive infant. Deputies contacted Amber who said her son was not breathing; the father, Scott, was giving CPR until a deputy arrived and began CPR. CC/EMS immediately transported the baby to Peace River Regional Medical Center. Major Crimes Unit detectives went to the hospital and the ER doctor said the infant arrived in full cardiac arrest. The baby’s urinalysis was positive for presence of opiates.
MCU Detectives talked to both parents; Scott said he was on methadone and his wife Amber goes to a methadone clinic. Scott also said he does not take any other medications and the methadone was in a locked drawer at home. Both signed a waiver to search their home and went with detectives to the home. During the search, three empty prescription bottles of Oxycodone prescribed for Scott were found in the locked drawer. Also found in the drawer were two empty prescription bottles of methadone prescribed to Scott. Detectives went back to the hospital where the ER doctor advised the baby died at 5:45 p.m. Two other children in the home, ages 2 and 9, were removed by the Department of Children & Families and tested by a pediatrician. The 2 year olds urine tested positive for Benzo and Oxycodone. DCF placed the two children in the care of their grandparents.
On Nov. 21, Charlotte County Medical Examiner Dr. R.H. Imami performed an autopsy and said he found nothing suspicious and no trauma to the body, however, toxicology was pending. On Dec. 21, detectives met with Dr. Imami who advised toxicology showed a toxic level of Oxycodone in the infant’s blood along with a high dosage of Oxymorphone in his urine. He explained the baby’s body metabolized the Oxycodone into Oxymorphone and the boy still had Oxycodone in his blood that had not yet been processed. Dr. Imami reported the boy died due to cardiopulmonary arrest with bronchopneumonia, secondary to Oxycodone intoxication. He added the Oxycodone intoxication was a contributing factor to the boy’s death.
MCU detectives continued their investigation and after re-interviewing both parents, learned they had been snorting Oxycodone the night before the boy’s death. Detectives said the abuse of Oxycodone caused the lack of supervision, allowing the children to ingest Oxycodone. Warrants were obtained and both Scott and Amber Landry were located Friday and taken to the Charlotte County Jail. This is Scott Landry’s 11th booking.
